Terms & Conditions

1. GENERAL PROVISIONS AND SCOPE OF APPLICATION

1.1. These purchase and sale terms and conditions (hereinafter – “Terms”) govern the legal relationship between UAB “Sporto Inovacijos”, company code 303326709, registered address Kęstučio g. 55-15, Kaunas, Lithuania (hereinafter – the “Seller”), operating under the brand “Raw Powders”, and all persons purchasing goods through the following websites (hereinafter – the “Website”):

1.2. By using the Website, the Buyer confirms that they have read these Terms and the Privacy Policy and agree to them. By using the Website, the Buyer also confirms that:
> is at least 18 years old and has the legal capacity to enter into binding agreements;
> all information provided during registration and ordering is true, accurate, and not misleading;
> does not use another person’s identity or personal data without lawful basis;
> undertakes to inform the Seller about any changes to provided data;
> is responsible for the security of their account login credentials and for not disclosing them to third parties. In order to ensure a higher level of security, the Seller may recommend periodic password updates and the use of strong login credentials; however, this is not mandatory. The Seller is not liable for losses arising from unauthorized access to the account if this occurs due to disclosure of login details or insufficient protection by the Buyer.

1.3. If the Buyer does not agree with the Terms, they are not entitled to use the Website or place an order.

1.4. These Terms apply to all Buyers unless mandatory legal requirements provide otherwise.

1.5. The Seller has the right to change these Terms at any time. Changes take effect upon publication on the Website.

2. CONTRACT FORMATION AND ORDER CONFIRMATION

2.1. The purchase agreement is considered concluded when the Buyer:
> creates a shopping cart,
> provides delivery details,
> selects a payment method,
> and fully pays for the order.

2.2. The contract is considered concluded at the moment of successful payment confirmation in the Seller’s system.

2.3. The automatic order confirmation email is only an informational message and does not constitute a separate contractual document.

2.4. The Seller begins fulfilling the contract by dispatching the goods to the Buyer.

3. PRICES AND TAXES

3.1. All prices are stated in euros (€) including VAT, if applicable.

3.2. Delivery costs are not included in the product price.

3.3. Outside the EU, customs duties, import taxes, or local charges may apply – these are paid by the Buyer.

3.4. Prices may change without notice, but this does not apply to already paid orders.

4. ORDER PROCESS

4.1. Adding items to the cart does not oblige the Buyer to purchase them.

4.2. The Buyer is responsible for the accuracy of all provided data, including delivery address, contact information, and other necessary details.

4.3. If the Buyer provides incorrect or incomplete information and the order cannot be properly delivered or is delivered to the wrong recipient, the Seller is not responsible for such delivery issues or delays. In such cases, additional delivery or correction costs may be charged to the Buyer, unless otherwise required by applicable law.

5. DELIVERY

5.1. Orders are usually dispatched within 1–3 business days.

5.2. Delivery times are indicative and may vary due to logistics partners.

5.3. Products are delivered to the address provided during ordering. The Buyer must ensure that the provided address is correct and complete.

5.4. The delivery address cannot usually be changed after order confirmation. In exceptional cases, with the Seller’s consent, the address may be changed if the order has not yet been transferred for fulfillment (e.g. warehouse processing or courier dispatch). The Seller does not guarantee such changes and is not responsible for delays, errors, or additional costs arising from address changes.

5.5. The Seller is not responsible for delays caused by third parties (couriers, customs, etc.).

5.6. If, in exceptional cases, the ordered product becomes unavailable, the Seller will immediately inform the Buyer and may offer a similar product. If the Buyer does not agree, the order (or part of it) is canceled and the paid amount is refunded.

5.7. If the Buyer does not collect the shipment within the period set by the courier or parcel locker and it is returned to the Seller, it is considered that delivery was not completed due to circumstances attributable to the Buyer. In such case, delivery costs are not refunded, and reshipping is carried out only after the Buyer pays additional delivery costs.

6. RISK AND OWNERSHIP

6.1. Risk of accidental loss or damage passes to the Buyer upon delivery.

6.2. Ownership passes to the Buyer only after full payment has been received.

7. RETURNS AND QUALITY ISSUES

7.1. The Seller follows applicable laws of the Republic of Lithuania and the European Union regarding consumer rights, including regulations on food product returns and exchanges.

7.2. Properly supplied goods (unopened, unused, within expiry date) are not returnable, except where required by applicable law, including statutory withdrawal rights where not excluded (e.g. health protection or hygiene-related products after opening).

7.3. In case of non-conforming goods, the Buyer may choose:
> replacement,
> price reduction,
> or refund.

7.4. These rights also apply to products with expired shelf life.

7.5. Return or exchange cases are handled via email communication with supporting evidence (photos, description).

7.6. The Buyer may be required to provide proof of purchase.

7.7. Once the return is approved, refunds are issued within 14 calendar days after receipt and inspection of the goods.

8. NON-CONFORMING GOODS AND DEFECTIVE PRODUCTS

8.1. Non-conforming goods are replaced or refunded in accordance with applicable law.

8.2. The Seller has the right to request reasonable evidence (e.g. photos, description or other information) required to assess the claim.

9. PRODUCTS (FOOD SUPPLEMENTS)

9.1. All products sold on the Website are food supplements.

9.2. Food supplements are not medicinal products and are not intended for:
> treatment of diseases,
> diagnosis,
> or prevention of diseases.

9.3. Information provided on the Website is general in nature and does not constitute medical advice. It does not replace consultation with a doctor or other healthcare professional.

10. ORDERS AND PAYMENT

10.1. The Buyer places an order, provides data, and pays using the selected payment method.

10.2. Available payment methods include bank transfers, card payments, or other methods indicated on the Website.

10.3. The order is considered accepted only after successful payment confirmation.

10.4. If the order is not paid, the Seller does not process it.

10.5. Payments are processed via third-party payment service providers (e.g. Montonio Finance, UAB or others), ensuring secure payment processing.

10.6. Discount codes are applied according to their terms of use. Unless otherwise stated:
> discounts cannot be combined;
> only one code may be used per order;
> discount codes cannot be exchanged for cash;
The Seller reserves the right to cancel incorrectly used codes or orders.

10.7. The Buyer agrees that order-related information (including confirmations and invoices) may be sent via email.

11. WEBSITE AVAILABILITY AND TECHNICAL ISSUES

11.1. The Seller makes reasonable efforts to ensure continuous Website availability.

11.2. However, the Seller does not guarantee uninterrupted or error-free operation, especially when issues arise from third-party services.

11.3. The Seller is not responsible for temporary disruptions beyond its control.

12. LINKS TO OTHER WEBSITES

12.1. The Website may contain links to third-party websites.

12.2. The Seller is not responsible for their content, services, or privacy practices.

13. PROHIBITED ACTIVITIES

13.1. The Seller applies reasonable measures to prevent fraud and misuse.

13.2. The Buyer agrees to cooperate with security checks if required.

13.3. Failure to cooperate may result in order suspension or cancellation.

13.4. It is prohibited to:
> disrupt Website functionality,
> use bots or automation,
> copy content for commercial use,
> attempt unauthorized access to accounts or data.

14. INTELLECTUAL PROPERTY

All Website content belongs to UAB “Sporto Inovacijos” (brand “Raw Powders”) and is protected by law.

15. PERSONAL DATA

15.1. Personal data is processed in accordance with applicable laws, including GDPR (Regulation (EU) 2016/679).

15.3. Data may be shared with third parties for order fulfillment purposes (payment providers, logistics, IT services).

16. ACCOUNT SUSPENSION AND TERMINATION

The Seller may suspend or terminate an account if:
> the Buyer breaches these Terms,
> false information is provided,
> the Buyer requests it,
> it is necessary for security or legal compliance.

17. LIMITATION OF LIABILITY

17.1. The Seller is liable only for direct damages caused by breach of these Terms.

17.2. The Seller is not liable for indirect or consequential damages unless required by law.

18. DISPUTES AND APPLICABLE LAW

18.1. Disputes shall be resolved through negotiations.

18.2. If an agreement cannot be reached, disputes shall be governed by the laws of the Republic of Lithuania.

18.3. The Buyer has the right to submit complaints to consumer protection authorities or the courts in accordance with applicable law. Complaints may also be submitted via the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/odr/ 

19. REVIEWS

19.1. By submitting a review, the Buyer grants the Seller the right to use and publish it without compensation.

19.2. The Buyer confirms that submitted content does not violate third-party rights.

20. FINAL PROVISIONS

20.1. If any provision becomes invalid, the remaining provisions remain valid.

20.2. These Terms constitute the entire agreement between the Buyer and the Seller.
